This license agreement is a legally binding agreement between you, as user and licensee, and bizcon AG regarding the use of the b.installed software product.
The acquisition and use of the software for non-commercial purposes is free of charge.
For commercial use, however, a license fee will be charged by bizcon AG.
Copies of the software may be made and distributed as long as the software is in its original state and is distributed with all files and as long as this is done free of charge.
No derivative works of this software may be created and distributed.
The software contains components which are licensed as Open Source software. The respective license terms are enclosed further below.
The licensee is granted a non-exclusive right of use for the Open Source Software by the respective right holders used, the conditions stipulated by the respective valid license terms apply.
The license terms of this license only apply to the components which are not listed as Open Source software.
This software inclusive all related files is provided “as is” without any warranty of any kind (expressed or implied) including but not limited to any implied warranties of its properties, functionality, fitness for a particular purpose, or non-infringement.
bizcon AG explicitly and in any case declines any liability for the use of this software and any resulting damages.
In no event shall bizcon AG or any of its suppliers be liable for any damages whatsoever arising directly or indirectly out of the use of the software, even if bizcon AG has been advised of the possibility of such damages.
This exclusion of liability applies to, but is not limited to, damages or costs incurred in the user’s or third party’s systems, loss of information of any kind, loss of future business profits, interruption of business operations and other financial losses resulting from the use of the software.
All risks of the use of the software lie with the user.
This license agreement is governed by the laws of the Federal Republic of Germany. If any part of this agreement is found to be invalid under such law, the validity of the other parts shall not be affected thereby.
